The
victim Mr. Sunil Sarkar stated before our fact finding
team that on 5.11.2009 a commotion took place between his
neighbours Mr. Sanjoy Sarkar, son of late Gopal Sarkar and
Mr. Gokul Sarkar, son of late Govinda Sarkar and he tried
to lessen the dustup. Later on 9.11.2009 Mr. Gokul Sarkar
reportedly filed a complaint at Jalangi Police Station
against Mr. Sunil Sarkar. On 2.12.2009 at about 9.30 pm
six police personnel from Jalangi Police Station came to
the house of the victim and started kicking on the door by
their boots using filthy languages. At that time the
victim was not present in his house. His wife, the lone
person in the house did not open the door of the house out
of fear. Then those police personnel left the place
issuing threats of dire consequences if the victim does
not attend the police station forthwith.
The victim did not attend the
police station out of fear of police harassment. On
3.12.2009 the victim received information that one police
officer of Jalangi Police Station called one Mr. Bijon
Sarkar, son of Mr. Bharat Sarkar and asked him to inform
the victim to talk with the said police officer. The said
Mr. Bijon Sarkar came to the house of the victim at about
4 pm called from his cell phone (being no. 9775102651) to
the said police officer on his cell phone (being no.
9775171007). The said police officer without disclosing
his identity asked the victim to call on his cell phone at
about 10 pm in the night. Accordingly the victim called
the said police officer on his cell phone and during
conversation the said police officer told him that one
complaint under section 308 of penal code has been
registered against him. He further told him that he would
settle everything and he would easily get bail. The said
police officer further demanded Rs.6000/- from him on
condition of closing the case. The victim told the said
police officer of his inability to give such huge amount.
Then the said police officer told him to think over the
matter and contact him later. Later the victim called the
said police officer on his cell phone but he did not
incline to talk with him. The victim again called the said
police officer on 6.12.2009 at about 5.44 pm and the said
police officer told him that he would not take any amount
less than Rs.3000/- in order to close the case. On the
same day the victim contacted our fact finding team and
disclosed the details of the incident. Then our fact
finding team tried to make contact with said police
officer on his cell phone being no. 9775171007 at about
9.17 pm on the same day but no response was made. Then our
fact finding team tried to locate and identify the user of
the said cell phone number 9775171007 and it was revealed
that the said cell phone number is being used by Assistant
Sub-Inspector of Police Mr. Sujoy Roy of Jalangi Police
Station.
The
victim stated before our fact finding team that on
8.12.2009 Assistant Sub-Inspector of Police Mr. Sujoy Roy
of Jalangi Police Station escorted with 13/14 police
constables reached the house of the victim in order to
arrest him. But the victim was present in his house at
that time and the said police officer called him on his
cell phone but the victim did not receive his call.
On 9.12.2009 the victim
lodged one written compliant before the Superintendent of
Police, Murshidabad detailing the incidents of ongoing
police threats and demand illegal gratitude by the
involved police personnel of Jalangi Police Station.
On 10.12.2009 at 9.40 pm
during a telephonic conversation, our team told Mr. Sujoy
Roy; the Assistant Sub-Inspector of Police of
Jalangi Police Station, that the victim reported that
several calls were made from his phone to the victim’s
phone. The said police officer told that he made calls as
the victim was not present in his house while he went to
arrest him. Then our team asked for the details of the
case in which the victim was implicated. Mr. Sujoy Roy
replied that he was implicated Jalangi Police Station Case
no. 615/2009 dated 9.11.2009 under sections 325(punishment
for voluntarily causing grievous hurt)/340(wrongful
confinement) of Indian Penal Code. Then our fact finding
team told him about the accusation of the victim of his
demand of money from the victim. The said police tried to
avoid the allegation saying that the victim was running
away from his house of being afraid of police, so he
called him in order to tell him to get bail from court as
he was implicated in bailable offences.
