BSF’s proclamations of encounters in most of the cases are fake encounters

   Masum got information that the victim Shyamsundar Mondal, District-Murshidabad was gunned down inside the Indian territory by BSF jawans of Rajanagar BSF Camp in an encounter with the smugglers. The incident took place on 22.8.2009 at about 7 pm at Dadur Ghat near the bank of river Padma under Raninagar Police Station, District-Murshidabad.  

The bullet fired by the BSF hit on the body of the victim at his back and exited from belly which indicates that the victim was not in attacking position upon the BSF. Though one complaint of encounter over the incident was lodged at Raninagar Police Station by BSF vide Raninagar Police Station case no. 486/09 dated 23.8.2009. The police also started a criminal case against the perpetrators Border Security Force jawans being Raninagar Police Station Case no. 492/09 dated 25.8.2009 under section 302 (murder) of Indian Penal Code but the accused are yet to be arrested.   

The perpetrators-Border Security Force jawans totally violated the right to life and liberty of the victim as guaranteed under the Constitution of India. Our attached fact finding report gives details of the case. 

The ghastly killing of persons from marginalized section became an order of the day along the Indo-Bangladesh border in general and in Murshidabad in particular. We have made several complaints with reference to non-compliance of set rules and guidelines fixed by the Commission.
