State repression upon Right to Freedom of Expression and Speech

 

 We would like to raise the fact with great concern that the tyranny of Government of West Bengal has reached its nadir. We have witnessed a continuous use of force and suppression on the any kind of dissention against the ruling political party; Communist Party of India (Marxist) and the state Government. The wrath of the State machinery is not only directed to the political opponents but to commoners, many of them are from socio economic marginalized sections are being falsely charged in serious criminal cases (some of them have multiple cases).

The victims are also being subjected to threat, mental and physical torture while in police custody also they are being deprived of their dignity and Constitutional rights.

The arrest of Mr. Sadananda Sinha, Mr. Bhanu Sarkar, Mr. Raja Sarkhel and Mr. Prasun Chatterjee were not in exceptions their arrest supporting our above observation.

 We conducted fact findings over the arrest of Mr. Bhanu sarkar and Mr. Sadanada Sinha.

 We came to know that Mr. Bhanu Sarkar, son of Mr. Manik Sarkar, aged about 36 years, is a member State committee of one civil society organization, named ‘Bandi Mukti Committee’. On 06/10/2009 around 7 pm he was busy with other fellows in poster campaigning at College Street area, in Kolkata on demand of release of Mr. Chatradhar Mahato, a member of ‘Pulishi Santrash Birodhi Jonoganer Committee’. This organization is fighting for the civil and political rights of the populace; mainly tribal, and voicing against police atrocities in and around of West Midnapore, Purulia, and Bankura Districts. In the mean time some police personnel in plain cloth reached at the place and arrested him along with one of his companions named Mr. Ramesh. Police took them to Armharst Street Police Station, Kolkata and then they were taken to State Head Quarter of Intelligence Bureau at Lord Sinha Road, Kolkata. They were also taken to Calcutta Medical College and Hospital for medical check up. No medical test was conducted. The doctor presented their only asked them whether were they fit or not and asked them to sign on a previously prepared report. Police behaved with undignified language with them. On the same day around 12 o’clock at night police released them.  It revealed from our fact finding that the main motto behind the arrest was only terrorizing the persons and thus restrains people’s movement against ruling political party.

Mr. Sadananda Sinha son of Late Gopal Chandra Sinha, aged about 58 years, owner of a press situated at Kolkata, was arrested by Kolkata police on 07/10/2009 in allegation that he has some connection with Communist Party of India (Maoist) while the party is not prohibited in this state of West Bengal. Police also ransacked his press. A criminal case; vide no 345/09 at Maniktala Police station, initiated against him under section 141/121A/124 of Indian penal code. The ground behind the allegation by the police is that previously some issues of a Bengali magazine named ‘Peoples March’ were printed from his press. Police alleged that some articles were subversive in nature while the fact is that ‘People’s March’ is a legal magazine registered with the Registrar of Newspapers of Government of India and is permitted to post at concessional rates by the Postal Department and the magazine is not a banned one at all. Presently he is spending his days behind the bars at Presidency Jail as an under trial prisoner.

 It is clear from the series of incidents that the Government of West Bengal run by Communist Party of India (Marxist) is trying to terrorize the common people and thus trying to restrain the people’s right to freedom of expression and speech.
