NHRC guidelines on encounters violated copiously by the State parties

   We got information that the victim Motisur Islam, a citizen of Bangladesh was gunned down inside the Indian Territory by BSF jawans of Tarali BOP, BSF Camp under Swarup Nagar Police Station, District -North 24 Parganas in an encounter with the smugglers. The incident took place on 5.7.2009 at about 10.15 pm. After the victim was hit by bullet, his body was allowed to remain on the spot for hours without any kind medical treatment for hours until his body was removed by the police on the next date. One complaint of encounter over the incident was lodged at local Swarup Nagar Police Station by BSF vide Swarupnagar Police Station Case No: 190/2009 dated 6.7.2009.  

In almost all these cases the practice that is followed is that criminal cases are registered against the victims of encounter death. It is taken for granted that the killings by BSF are in self-defense. This raises doubts about their intentions which seem to be directly eliminating the victims, instead of subjecting them to the due process of law for punishing the guilty.

 We regret to find that the guidelines issued by the Commission in case of encounter death were being defiantly flouted in this case. The right to life of the victim has been grossly violated by the perpetrator BSF jawans.
