Mostafa
Mondal was living a peaceful life with his family of wife
and children at the bank of river Padma; infamous for
river erosions. He lost his agrarian lands during
consistent land erosions by Padma and without any
appropriate delivery measures for appropriate resettlement
measures. He is living at a near proximity of BSF’s border
out post. He lost his lands due to the erosion but till
having a ¼ decimal of lands to cultivate under Parashpur
Mouza of Khatian number 332’s 193/ 761/ 193/ 192 dag
numbers. His family is deprived off any BPL deliverance,
though enlisted in BP listing.
On the
fateful night and time; 14.11.2009, BSF personnel were
roaming at the place of occurrence and the victims were
preparing to go to their bed. In the mean time the BSF
personnel came to the place near to the adjacent of their
homes and lit fire on the stacked jute sticks. During that
the Mostafa’s house was in a position to caught fire, so,
his wife and children started screaming and during that
the member of Ghoshpara Gram Pancayet; Mr. Saiful Shah,
and Anarul Shah, Bajlur Shah , Mader Seikh and many others
rushed to the place and extinguished the fire to reach the
habitation of Mr. Mostafa Mondal by using waters from
river Padma.
After having
a discussion with the panchayet members and
neighbors, who witnessed the whole incident the fact
finding team was convinced that the event was not only
destroyed his property which was only property belong to
him for further sustenance but made a psychological scar
on his wife and children.
Thereafter
the said perpetrator number; the Sub- Inspector tried for
a reconciliation with Mostafa and made false assurance to
compensate his loss after he broke his promise, Mostafa
filed a complaint to Jalangi police station on 16.11.2009,
and it was registered as General Dairy Entry vide number
1048/09. While the police not taken the incident seriously
as it was deserved, the victim informed us about the
indifference of police. Then our monitor on 17.11.2009
called up Mr. Harish Ali, the Officer in Charge of Jalangi
police station over telephone and tried to convince him
about the illegal act by the said BSF personnel, the OC
tried to shield the BSF personnel by saying the allegation
is baseless.
As the
indifference by Jalangi police station continued, the
victim again made request before us and he was suggested
by us to call Circle Inspector; Domkal and on 20.11.2009,
Mostafa called CI- Domkal over telephone and narrated the
whole incident to him. At the very next day, 21.11.2009 at
about 1.30 p.m. Mr. Milan Mallick, Sub Inspector, Jalangi
police station came to the place of incident and during
his enquiry he interacted with M/S Bajlur Rahman, Mader
Seikh, Anarul Shah, Najkul Shah and others. After that the
said SI visited Dayarampur BSF, BOP camp and after
spending few minutes at the said BSF camp, returned to
Jalangi police station.
But after
departure of the said SI of Jalangi PS, Mr. Abdur Rajjak,
son of Late Roshan Ali alias Akhtar, resident of Nakurtala,
Kapasdanga, post and district- Murshidabad, a mason
working inside the camp overheard that the BSF personnel
were discussing among them, that they will kill Mostafa
and throw his body to river Padma. The said mason informed
us about the conversation on 22.11.2009, while Abdul Bari
Shah, Sudhar Chowdhury, Noor Islam and other villagers of
Dayarampur were also present
