We
conducted our fact finding upon information received that
Mr. Gurupada Mondal, residing in a remote village in
district-Murshidabad near Indo-Bangladesh border was
denied to catch fish in the river Padma by the perpetrator
BSF jawans of Bamnabad BSF Camp, Police Station-Raninagar
instead of having a Fisherman Identity Card duly issued by
the District Magistrate, Murshidabad. The perpetrator BSF
jawans allegedly restrained the victim to catch fish as he
earlier did not fulfill their demand of supply fish to
them free of cost.
The victim promptly lodged
complaint in this matter before the administration but he
is yet to get any remedy till date. Our attached fact
finding report gives details of the case.
The outposts of Border
Security Force (BSF) are posted in the vicinity of the
villages instead of the actual border line; the villagers
living near to the border in fact have no protection. It
is also well-known that the villagers face torture and
harassment by BSF.
The perpetrator BSF
personnel acted arbitrarily and illegally by depriving the
victim from discharging his valid and lawful occupation.
The victim’s right to life and right to livelihood under
Article 21 of Constitution of India have been grossly
violated by perpetrator BSF.
