Entajul Seikh(25 years) son of Mr. Mojhar Seikh lived in Kaharpara village with his 3 brothers; Mr. Riajul Islam(28 years),Mr. Hafijul Seikh(16 years) and Mr. Safikul Islam(14 years) with 2 sisters namely Ms Runa Layla(18 years) and Ms Hira Khatun (12 years). Entajul and his brother Mr. Riajul was daily labor and worked in other’s agrarian land because they did not own cultivable lands. They were facing hardships due to their poor economic background but were not listed in Bellow Poverty Level though received lot of promises from the political leaders. Entajul was compelled to join cross border smuggling activities to met two square meals for him and his family.
On 6th July 2010, Entajul Seikh met with his companions Mr. Jiarul Mollah, son of Mr. Islam Molla; Mr. Masadul Seikh son of late Amiuddin Seikh and Mr. Nantu Seikh, son of Mr. Sukur Seikh of Kaharpara Village under Raninagar PS and Mr. Faruk Seikh of Guripara village, under Police Station – Rajpara, District- Badsahi in Bangladesh at the dusk and planned for smuggled out cows from the said point. Subsequently, they smuggled out about 20-25 cows to Bangladesh and while returning from their destination at about 1 AM, i.e. on 7th July, the posted Border Security Force (BSF) constables of ‘B’ Company, Battalion Number-52, and Outpost number-5 of Kaharpara Head Quarter saw their movement and started indiscriminate firing. After sensing that they had been spotted by the BSF, they wanted to flee from that place but Nantu Seikh and Faruk Seikh fell down on the ground due to the continuous firing by those BSF constables and died later on the spot, as reported by the BSF, they not even brought to any medical deliverance unit. Entajul was caught by the BSF constables and his other companions except Nantu and Faruk were successfully escaped from the scene. Entajul was brutally tortured and later fired twice by the BSF personnel from close proximity to end his life. The torture was evident while the corpse of Entajul was brought to Godhanpara Primary Health Center at 9.00 am on 7th July 2010, it was observed there that due to inhumane torture his right leg was became a lump.
The body of Entajul remained lying prostrate on the ground at the place of incident and no BSF official tried to extend any medical care for the deceased. On 7th July 2010 at around 9 AM his body was sent to Godhanpara Primary Health Center by the BSF personnel, where it was declared that Entajul was dead only proving that from 1am to 9 am, for eight hours Entajul was not declared dead by any competent person, therefore by a doctor and at 11 AM the BDO of Raninagar II, Mr. Arunava Das made inquest over the body. Subsequently, an unnatural death case initiated vides U/D case number 14/10. Our fact finding team reached the place of incident on 10th July 2010 and gathered information from Mr. Mahidul Islam, son of Mr. Samsuddin Shah; Mr. Ajhar Mollah, son of Mr. Abutaleb Mollah; Mr. Wajud Sarkar, son of Mr. Nurul Islam; Farid Mollah, son of late Janmohammad Mollah and Mr. Samsujjoha Seikh son of late Badruddin Seikh, all of them observed that though the deceased was smuggling cows at the time of occurrence but while killed, they were no way in a position or intention to attack the BSF personnel as stated by the BSF personnel in their complaint to Raninangar Police Station. On 19th July 2010 the member of our fact finding team met with Duty Officer of Raninagar Police Station Mr. Niranjan Sarkar, Assistant Sub Inspector (ASI). After a discussion with him over this incident fact finding team came to know that the Assistant Commandant(A/C) of ‘ B’ Company, Battalion Number-52, Kaharpara Head Quarter of Border Security Force lodged a complaint against Entajul in Raninagar Police Station being Raninagar PS Case Number 356/10 dated 7th July 2010 under sections 147(Rioting) / 148(armed with a deadly weapon) / 149 (If an offence be committed by any member of an unlawful assembly, every other member of such assembly shall be guilty of that offence) / 180(Refusing to sign a statement made to a public servant when legally to do so.) / 188 (Disobedience to an order lawfully promulgated by a public servant, if such disobedience caused any obstruction annoyance or injury to persons lawfully employed.) 325(Voluntarily causing grievous hurt.)/326(Voluntarily causing grievous hurt by dangerous weapons or means)/ 353(Assault or use of criminal force to deter a public servant from discharge of his duty)/ 360(Kidnapping from India)/ 379(Theft)/ 307 (attempt to murder) and 411(Dishonestly receiving stolen property, knowing it to be stolen.). In this case a seizure of 1 Daw ( a sharp weapon), few wooden stick, one mobile phone, 6 cows and 25 Rupees and 50 paisa were shown from the deceased.
On the same day our fact finding team members met with Mr. Riajul Islam, Brother of Entajul and came to know that he lodged a written complaint to the Officer in Charge (OC) of the Raninagar police station against involved BSF personnel, but he refused to accept the complaint and driven him out of the said police station.
On 22nd July 2010 our fact finding team went to the office of Superintendent of Police of Murshidabad with Mr. Riajul Islam and Riajul lodged a written complaint to the Superintendent of Police (SP), it was received by his office but shamefully the SP has not initiated any inquiry and registered the complaint, till date. |
