On 22/10/2009 we lodged one
complaint before several human rights institutions
including your Commission urging for urgent intervention
protecting the safety and security of a victim of rape
allegedly committed upon her on 22/10/2009 by one Border
Security Force jawan posted at Out-Post no. 2 under
Bamnabad BSF Camp, Police Station-Jalangi, District-Murshidabad
on the date of the incident.
We have been informed that
soon after lodging of our complaint the Border Security
Force personnel from Rajanagar BSF Camp accompanied with
some notorious persons made regular visits to the house of
the victim woman threatening them with dire consequences
not to lodge any formal complaint on the alleged incident
of rape before the authorities.
On 27/10/2009 the victim’s
father succeeded in lodging one written complaint at
Jalangi Police Station bringing allegations of offence of
rape committed on his daughter by the perpetrator BSF
jawan and a criminal case vide Jalangi Police Station
Case no. 587/09 dated 27/10/2009 under section 376(2) (G)
/506 of Indian Penal Code was started. The accused persons
are yet to be arrested and they taking such opportunity
have been continuously putting the victim and her family
under severe threats and pressure to withdraw the
allegations. The higher officials of BSF are also playing
conspicuous role in screening the accused persons.
The police have been
remarkably lenient in collecting vital evidences of crime
in this case. There was no medical examination has been
done of the accused jawan of Border Security Force as well
the victim till date and the wearing apparels of the
victim used at the time of the incident have not been
seized by the police till date.
