We have come across an incident of
shocking treatment by police of North Port Police Station,
Kolkata upon two victims who are minors by age. They
belong to homeless families and reside near Armenian Ghat,
under jurisdiction of the said Police Station. On
11.8.2009 the perpetrator police personnel captured the
minor boys upon suspicion of being thief and kept them in
confinement at police station for hours. The victims were
physically abused and tortured in custody of police. Even
the parents of the victim boys were abused by police of
North Port Police Station when they tried to pursue the
matter. Our attached fact finding report gives details of
the case.
The right to life of the victims
has been grossly violated by the perpetrator police
personnel as guaranteed under Article 21 of the
Constitution. Even if it is so that the victim children
have allegedly committed any crime then they supposed to
be protected and treated under the provisions of the
Juvenile Justice Act, 2000. But the acts of the
perpetrator police personnel are against the approach
deserved in the adjudication and disposition of matters in
the best interest of children and their basic human rights
are fully protected.
