On 09th July 2010 at
around 9 pm Mr. Abdul Khalek Mondal along with his minor son Tultul Mondal
and around 12 others were trying to smuggle some cattle through the area in
between Outpost No 1 of Rajanagar Border outpost and Outpost no. 1 of
Mohanganj Border outpost.
Around 9.45 pm the team of those smugglers came under notice of the
constables posted in both the outposts. Soon those BSF personnel started
indiscriminate firing on them. It was reported that total 19 round of
bullets were fired. One bullet entered into Abdul Khalek’s body through
right side of his chest and the same was exited through the upper right side
of his back. Severely injured Abdul Khalek with help of his son Tutul along
with two others of their accomplices fled away from the place towards Char
Khidirpur under Motihar police Station of Bangladesh. As reported, around
10.20 pm Abdul Khalek fell down on the ground on his way to Bangladesh and
thereafter his unconscious body was taken to the house of one Mr. Mostafa at
Char Khidirpur in Bangladesh. It was heavily bleeding from Abdul’s body
then. His accomplices tried to contact the doctors of that area for urgent
treatment but failed. Then they planned to take him to Rajshahi Medical
College Hospital; but around 11 pm they felt that Abdul Khalek had already
breathed his last. His son, Master Tutul and two others then tried to take
his unconscious body to his home at India.
Around 2.15 am on 10th July while they were returning with the unconscious
body of Abdul to India through the in between area of Outpost No 1 of
Rajanagar Border outpost and Outpost no. 1 of Mohanganj Border outpost, they
came under notice of few BSF personnel, were posted there. Those BSF
personnel put light upon them from their torch. Consequently Tutul and two
others kept the unconscious body there and fled away from the place. Around
6.45 am Mr. Nilanjan Roy; Sub-Inspector of Raninagar Police Station
approached that place where the unconscious body was lying and conducted
inquest of the said body according to section 174 of Criminal Procedure Code
(CrPC) of India while the body was not declared as dead by any doctor till
then. No relative of Abdul Khalek was present at that time. Subsequently
around 9 a.m. the body was taken to Godhanpara Primary Health Centre by one
BSF vehicle bearing number PB-08BA9456 and the body was declared as dead by
Doctor Mr. Utpal Choudhury. Around 10.35 am our fact finding team tried to
talk with Mr. Nilajan Roy regarding the incident, but he did not entertain
our team. Thereafter at around 11 am the body was taken to Raninagar police
station and there Mr. Arunava Das; the Block Development Officer of
Raninagar II conducted the inquest of the dead body. It revealed from few
snaps; which our fact finding team could collect during while the inquiry
was being conducted, that one villager namely Mr. Badal Seikh was physically
examining the dead body and the magistrate was taking note as per the
unprofessional villager was narrating and Mr. Nilanjan Roy, SI of Raninagar
PS was instructing.
The body was then sent to Lalbagh Sub Divisional Hospital for post mortem
examination (PME) and the same was done on the same day.
Raninagar police initiated one criminal case against deceased Mr. Abdul
Khalek Mondal. The case number is 360/10 dated 10/07/2010 under sections 147
(Rioting) / 148 (Rioting, armed with a deadly weapon) / 149 (involved in a
criminal offence committed by a group) / 186(obstructing public servant from
his duty) / 188 (disobedience of government order) / 353 (assault or use of
criminal force against a public servant) /307 (Attempt to murder) / 379
(theft) / 411 (dishonestly receiving stolen property) of Indian Penal code,
12 P.P Act (depart from India without having a valid passport) and 25
(possession for sale, transfer, conversion, repair, test or proof of any
arms or ammunition) /27 Arms Act (using or arms or prohibited ammunitions).
The above sections have been charged as per the complaint made by the BSF
personnel against the deceased victim while our fact finding team was
reported that none of the BSF personnel was injured during the incident and
no weapon was seized from him.
On 14th July 2010 around 4 pm brother of the deceased victim went to
Raninagar police station to lodge his complaint regarding the killing. The
duty officer only received the complaint but denied to provide any case
number in absence of the officer-in-charge. Till date the victim family is
in total dark whether any case has been initiated or not. No visible enquiry
was started yet.
On 19th July 2010 around 2.58 pm our fact finding team went to Raninagar
police station to talk with the Officer-in-Charge of the said police station
(PS) but he was not in the PS then, and no information was given by the
available police officers. |
